Terms of Service

1. Acceptance of Terms

By accessing and using this website or engaging my web development services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service may be updated from time to time without notice. Your continued use of the service constitutes acceptance of those changes.

2. Services Description

I provide professional web development services including but not limited to:

• Custom website development and design
• E-commerce platform development
• Web application development
• Mobile application development
• UI/UX design services
• Website maintenance and support
• Technical consultation and strategy
• Performance optimization

The specific scope of work, deliverables, timeline, and pricing will be outlined in a separate project agreement or contract.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete project requirements
• Supply necessary content, images, and materials in a timely manner
• Respond to communication requests within agreed timeframes
• Make payments according to the agreed schedule
• Provide feedback and approvals in a timely manner
• Respect intellectual property rights
• Use the delivered work in accordance with licensing terms
• Maintain confidentiality of sensitive information shared during the project

4. Payment Terms

Payment Schedule

• Project-based work typically requires 50% payment upfront and 50% upon completion
• Hourly work is billed monthly with payment due within 15 days of invoice
• Retainer agreements require monthly payment in advance
• Additional work outside the original scope will be billed separately

Late Payments

Payments not received within 30 days of the due date may result in:

• Suspension of work on current projects
• Late fees of 1.5% per month on overdue amounts
• Removal of websites from hosting servers
• Legal action to recover outstanding amounts

5. Intellectual Property Rights

Client Content

You retain ownership of all content, text, images, and materials provided to me for use in your project.

Custom Development

Upon full payment, you will own the custom code and design elements created specifically for your project, excluding:

• Third-party libraries and frameworks
• Open-source components
• My proprietary tools and methodologies
• Code templates and boilerplate components I've developed

Portfolio Rights

I reserve the right to display completed work in my portfolio and use it for marketing purposes unless otherwise agreed in writing.

6. Project Timeline and Delivery

Project timelines are estimates based on the information provided at the time of proposal. Actual delivery may be affected by:

• Changes in project scope or requirements
• Delays in client feedback or content provision
• Third-party dependencies or integrations
• Unforeseen technical challenges
• Force majeure events

I will communicate any potential delays as soon as they become apparent and work to minimize their impact.

7. Warranties and Disclaimers

Limited Warranty

I warrant that:

• Services will be performed with professional skill and care
• Delivered work will be free from defects for 30 days after delivery
• Custom code will be original and not infringe on third-party rights

Disclaimer

Except as expressly stated above, all work is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

My total liability for any claim arising from or relating to these terms or my services shall not exceed the total amount paid by you for the specific project or service in question.

I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or business opportunities
• Loss of data or information
• Business interruption
• Loss of reputation or goodwill

9. Termination

Either party may terminate a project agreement with written notice. In case of termination:

• You will pay for all work completed up to the termination date
• I will deliver all completed work and transfer any agreed assets
• Confidentiality obligations will continue after termination
• Any refunds will be determined based on work completed and expenses incurred

10. Confidentiality

I understand that during our working relationship, I may learn about confidential information. I agree to:

• Keep all client information strictly confidential
• Not disclose confidential information to third parties
• Use confidential information only for the purpose of providing services
• Return or destroy confidential information upon request

This obligation continues indefinitely, even after the termination of our working relationship.

11. Governing Law and Dispute Resolution

These terms shall be governed by the laws of Pakistan. Any disputes arising from these terms or my services shall be resolved through:

• Good faith negotiations between the parties
• Mediation if direct negotiations fail
• Binding arbitration as a final resort

Both parties agree to make reasonable efforts to resolve disputes amicably before pursuing formal legal action.

12. Force Majeure

I shall not be liable for any delay or failure to perform my obligations due to events beyond my reasonable control, including but not limited to:

• Natural disasters, pandemics, or acts of God
• Government actions or regulations
• Internet or telecommunication failures
• Third-party service provider outages
• Cyber attacks or security breaches
